This week on Legally Us, Rachael Bennett, a certified family law specialist and senior attorney at Sullivan Law & Associates, breaks down The Real Housewives of Miami star Lisa Hochstein and her ex-boyfriend Jody Glidden’s criminal charges in connection to her ex-husband, Leonard “Lenny” Hochstein.

Lisa, 43, and Glidden, 52, are each facing one count of interception of wire, oral, or electronic communications, according to court documents obtained by Us Weekly on Monday, April 13.

On Wednesday, April 15, Lisa turned herself in to authorities with her attorney Jayne Weintraub telling TMZ that the surrender was voluntary and that her client “has nothing to hide” as the legal process plays out.

“This is pretty serious. They’re accused of secretly bugging Lenny’s car with a listening device. Now, some states require what’s called an ‘All Party Consent’ if you’re going to record someone, and in Florida, that’s definitely one of the laws there,” Bennett explains to Us. “That means that if you record someone without their knowledge or permission, that recording is considered to have been obtained illegally in Florida. This is considered a third degree felony, which means she could face up to five years of prison time if she’s convicted.”

According to the documents from March 12 to March 31, 2023, Lisa and Glidden allegedly “unlawfully and intentionally” intercepted, attempted to intercept, or sought to have others intercept oral communications involving Lisa’s ex-husband, Leonard ‘Lenny’ Hochstein, as well as those he spoke with.”

Weintraub, along with Howard Srebnick and Frank Gaviria, Glidden’s lawyer, told Us on Monday that “This matter is part of a contentious divorce proceeding and does not belong in criminal court,” which Bennett says could “provide key context.”

“As we all know, divorces can absolutely bring out the worst kind of behavior from even the most reasonable people,” Bennett tells Us. “But this defense could also be seen as an effort to downplay the situation, so I think she’s going to have to be careful not to minimize her actions here if these claims are true.”

Glidden was arrested and taken into custody in Miami Beach, Florida, last month. He is no longer in the jail database as of Monday.

Lenny, 59, filed for divorce from Lisa after 12 years of marriage in May 2022. The pair finalized their split in November 2024 and share custody of their two kids, son Logan, 10, and daughter Elle, 5. Lisa split with Glidden earlier this year.
