The kratom industry has poured millions of dollars into political action committees, candidate campaigns and lobbying efforts to fight blanket bans on products containing the opioid-like supplements and persuade lawmakers to target synthetic alternatives instead, records show.

Leading the way is the American Kratom Association — which has spent more than $1 million on lobbyists over the past decade, including $443,000 alone this year, according to data tracked by OpenSecrets.com.

Their top lobbyists include longtime Capitol Hill power broker and former Reagan administration official Mac Haddow and former state Sen. David Carlucci (D-Rockland).

Botanic Tonics, an Oklahoma-based supplement company founded by Jerry W. Ross, has reportedly spearheaded a multi-million dollar lobbying effort that leveraged private audiences with top federal honchos to promote the benefits of natural kratom leaves of a tropical tree native to Southeast Asia.

The effort included pouring $1.1 million into PACs affiliated with former presidential candidate and Health Secretary Robert F. Kennedy and another $443,000 to the Republican National Committee to help secure a private meeting for Ross with Vice President JD Vance to discuss potential crackdowns on high-potency 7-hydroxymitragynine (7-OH) and other synthetic kratom alternatives while protecting natural kratom supplements, the New York Times reported.

Ross allies also formed a company called “Stop Gas Station Heroin” to promote natural kratom as the safer option, paying Checkmate Government Relations – a lobbying firm owned by Kennedy ally Ches McDowell – at least $750,000, records show.

The American Kratom Association-led lobbying effort to boost natural kratom products by cracking on synthetic kratom was “effective” in New York, conceded state Assemblyman Phil Steck.

The upstate capital region Democrat sponsored legislation to ban synthetic kratom statewide, which was approved by the Legislature in June but is still waiting on Gov. Kathy Hochul to sign it in to law.

He said if he had his way, the state would also ban natural, or “distilled,” kratom products because they have “dangerous side effects,” even if the health risks aren’t as serious as those linked to synthetic kratom products.

But legislative leaders and Hochul’s office backed away from that broader approach, Steck said.

Haddow, also the senior fellow on public policy at the American Kratom Association, said the money being spent by natural kratom backers on lobbying and contributions “is to get a seat at the table” to ensure the “decision makers are being fair,” adding the competing synthetic kratom industry does the same thing.

“It’s not a perfect system … but in order to have access to these [government] offices we have to retain lobbyists,” said Haddow.

He also claimed natural kratom offers major health benefits, adding the nation’s 24 million consumers of these products primarily use it to boost energy, combat anxiety and depression, manage chronic pain, and beat opioid addiction.

The US Department of Justice on Friday announced it was taking steps to crack down harder on synthetic kratom based on recommendations from the US Department of Health and Human Services.

Reps for the HSS declined to comment on the kratom industry’s lobbying efforts, but Kennedy boasted about the new guidelines in a statement saying, “We are drawing a clear line between natural kratom and dangerous, enhanced opioid products.”
