Halle Berry‘s ex Olivier Martinez is seeking a temporary restraining order against her while accusing the actress of abusing their 12-year-old son, Maceo.

According to court documents obtained by Us on Thursday, October 1, Martinez, 60, filed a request for a domestic violence restraining order. Martinez claimed an alleged incident took place on September 26 between Maceo and Berry, 60. According to Martinez, Maceo called him asking to be picked up from Berry’s home because she allegedly “physically attacked him and choked him.”

“While on the phone with our son, I heard him panicking and heard [Berry] still yelling at him in the background,” Martinez alleged. “When I arrived [Berry] did not come out of the home but [her] partner assisted our son in carrying his back to my car.”

Martinez claimed that Berry “texted” him the following morning to apologize for the alleged incident.

Martinez also claimed that this was not the first instance of alleged abuse between Maceo and Berry. He accused Berry of “unprovokedly” attacking Maceo, claiming she allegedly put him in “choke holds” while she trained in “mixed martial arts.”

Maceo allegedly told his mother that he “hates” it when she brings him into the training but Berry “downplayed the incidents.” Maceo also allegedly told his father that he wanted to “kick” Berry’s “ass” the next time the alleged incident occurred but Martinez allegedly told him that “a son should never fight his mother.”

“The way I was raised I believe that a physical fight between a mother and son should never happen, so I discouraged our son from escalating conflict with his mother to physical violence,” Martinez claimed. “Unfortunately this is exactly what happened this last Saturday, when [Maceo] had to physically fight off his mother to escape.”

Martinez claimed that since the alleged altercation, Maceo does “not want to spend time” at Berry’s home and appears to be “traumatized from the incident.”

Martinez requested a restraining order for himself and Maceo against Berry and asked that the exes’ 50-50 custody arrangement be temporarily changed to a “no contact order.”

“I do not want to permanently sever the relationship between our son and [Berry] but I do not believe that they should be interacting with each other until [Berry] can take sufficient accountability for her actions,” Martinez stated.

 

In addition to the restraining order, Martinez wants Berry to undergo a psych evaluation plus drug and alcohol screenings. 

Berry’s attorney Marina Beck addressed Martinez’s allegations in a statement to Us.

“To say this filing is entirely meritless and deliberately misleading would be an understatement,” the statement read. “There is voluminous evidence, including numerous judicial rulings, that Olivier Martinez repeatedly violated court orders and interfered with necessary therapeutic and educational interventions to the detriment of his and Halle Berry’s minor son Maceo – misconduct for which Mr. Martinez has already been legally sanctioned.”

The statement continued, “In a way, today’s filing is not entirely unexpected from an individual with a well-documented history of erratic, possessive and violent behavior. Fortunately, Halle is used to this kind of outrageous conduct from Mr. Martinez and, while she is deeply saddened, she will not allow it to deter her from fighting for Maceo’s best interests and providing him with the love and support he needs.”

Berry and Martinez tied the knot in July 2013 after three years of dating. Three months later, the pair welcomed Maceo. In October 2015, Martinez and Berry separated after two years of marriage. The exes became entangled in a legal battle over their divorce and custody arrangements. Their divorce was finalized in August 2023, seven years after they were legally declared single in December 2016.
