Judge Denies Lindsay Clancy Lawyer’s Latest Bid to Drop Her Murder Charges After Mistrial

A judge denied Lindsay Clancy’s lawyer’s latest attempt to get her murder charges dropped after she was accused of killing her three kids in January 2023.

Judge William Sullivan denied a motion filed by Clancy’s lawyer, Kevin Reddington, to have her found not guilty on all three first-degree murder charges on Thursday, October 1. The decision came nearly one month after her case ended in a mistrial on September 4 when the jury was unable to reach a unanimous verdict.

During a hearing on Tuesday, September 29, Reddington argued that the charges should be dropped because he believed that the prosecutors were unable to prove that Clancy, 36, killed her three children – Cora, 5, Dawson, 3, and Callan, 8 months – during the nearly seven-week trial.

Reddington previously did not dispute that Clancy strangled her three children. He argued she was not criminally responsible due to postpartum psychosis and other mental health struggles she was facing at the time of her kids’ deaths. He has since changed his approach, stating on Tuesday that there was never a full investigation into the deaths of Clancy’s children and that authorities “just immediately assumed that this woman was guilty.”

Two days after Reddington made the argument, Sullivan shut down the request to have Clancy’s charges dropped.

“With respect to the elements of murder and the identity of who committed the alleged crimes, the evidence presented by the Commonwealth in its case in chief … was sufficient to satisfy any rational trier of fact beyond a reasonable doubt,” Sullivan wrote, according to CNN.

Despite Sullivan’s refusal to drop the charges after more than three attempts by Reddington, the future of the case is currently unclear. Both Plymouth County District Attorney Timothy Cruz and Clancy’s defense team have not publicly commented on if they’re in the process of plea negotiations. Meanwhile, Cruz has not shared whether or not the prosecution wants the triple-murder case to go back to trial.

Additionally, Clancy still has another motion to dismiss the case that is currently pending in court.

In late August and early September, the jury deliberated for seven days before they determined they could not come to a unanimous decision. While 11 of the jurors found Clancy not guilty by reason of insanity, one holdout juror refused to find her not guilty.
